Terms and Conditions

Version 1.1

Last updated: August 16, 2026

1. Provider identification

The owner and operator of Seiday is José Luis de la Morena García, a natural person resident in Spain. Contact email: legal@seiday.com.

Seiday is currently offered free of charge and for non-commercial purposes. If the service becomes commercial in the future, this information will be expanded with the details required by Article 10 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).

2. Purpose and acceptance

These Terms and Conditions govern access to and use of the Seiday app and its associated services. By signing up and using Seiday you declare that you have read and accepted these Terms and the Privacy Policy. If you do not agree, you must not use the app.

3. Description of the service

Seiday is a personal and private voice diary app. It lets you record an audio entry of up to 60 seconds a day, accompanied by an emotion emoji and, optionally, an image and a title, and keep it organised in a calendar. It includes features such as streaks, levels, achievements, summaries (Seiday Wrapped) and time capsules (recordings that are sealed until a future date that you choose).

Seiday is not a social network: your entries are private by default and only you have access to them, unless you decide to share a specific recording by link.

Seiday is not a healthcare service nor a tool for diagnosis, treatment or psychological support. The mood statistics it offers are for personal and informational purposes only and do not constitute medical advice. If you are going through emotional distress, please see a healthcare professional or contact emergency services.

4. Registration and account

To use Seiday you must create an account with a valid email address or by signing in with Apple or Google. You are responsible for the accuracy of the data you provide, for keeping your credentials confidential and for all activity carried out under your account. You must notify us immediately of any unauthorised use.

5. Minimum age

Seiday is aimed at people aged 14 or over, the minimum age to give consent to data processing in Spain (Art. 7 LOPDGDD). If you live in another country of the European Economic Area, the minimum age set by its law will apply, which can be as high as 16. By signing up you declare that you meet the minimum age applicable in your country of residence or that you have the authorisation of the person who holds parental authority or guardianship over you.

6. Your content and licence

You retain ownership of all the content you create in Seiday (recordings, images, emotions, titles and time capsules). So that we can provide the service, you grant us a limited, non-exclusive, royalty-free and revocable licence for the sole purpose of storing, processing and showing you your own content within the platform. This licence ends when you delete the content or your account.

We do not use your content to train artificial intelligence models, and we do not analyse it or hand it over to third parties for commercial or advertising purposes.

7. Recordings with third parties and sharing

You are solely responsible for the content you record. If your recordings include the voice, image or data of other people, it is up to you to make sure you have their knowledge or consent where necessary.

If you share a recording or a time capsule by link, anyone who has it can access the content while sharing remains active. You are responsible for deciding who you share that link with and for not infringing the rights of third parties. You can revoke sharing at any time from the app.

8. Acceptable use

By using Seiday you agree not to:

  • Use the app for unlawful or fraudulent purposes.
  • Record or share content that is illegal, that infringes the rights of third parties or that violates the privacy of other people.
  • Impersonate another person or entity.
  • Attempt to access other people's accounts, data or systems.
  • Interfere with, overload or damage the operation of the service or its infrastructure.
  • Access the service by automated or mass means without authorisation (scraping, bots, etc.).

9. Intellectual property

The app, its software, its design, the “Seiday” brand and other elements are owned by the provider or its licensors and are protected by intellectual and industrial property law. These Terms do not grant you any right over those elements beyond using the app as provided for here.

10. Availability and changes to the service

We strive to keep the service available at all times, but it may be interrupted for maintenance, updates or causes beyond our reasonable control. We may modify, suspend or discontinue features, giving you reasonable advance notice when this significantly affects the service. We recommend regularly using the data export function to keep a copy of your content.

11. Suspension and termination

You can delete your account at any time from the app settings. We may remove content that infringes these Terms or the law, and suspend or cancel accounts that breach them, in a proportionate manner and, whenever possible, with prior and reasoned notice. After cancellation, your content will be deleted as set out in the Privacy Policy.

12. Warranties and liability

Seiday is provided “as is” and “as available”. To the fullest extent permitted by law, we do not guarantee that the service will be free of errors or interruptions. Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited by law, including liability for wilful misconduct or gross negligence, personal injury and the rights that consumer protection law mandatorily grants you.

13. Data protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

14. Changes to the Terms

We may modify these Terms to adapt them to changes in the law or in the service. We will publish the current version with its update date and, if the changes are substantial, we will notify you through a notice in the app or by email, asking for your acceptance again where necessary. If you do not accept the new Terms, you may stop using the service and delete your account.

15. Governing law and dispute resolution

These Terms are governed by Spanish law. If you act as a consumer, you keep the mandatory rights granted to you by the law of your country of habitual residence and you may bring proceedings before the courts of your own place of residence. In addition, the European Commission provides an online dispute resolution platform available at ec.europa.eu/consumers/odr.
